Terms of Use
Effective July 28, 2026
These Terms of Use (“Terms”) govern your access to and use of the ePortfolio app, website, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and accounts
You must be at least 13 years old and meet any higher minimum age required in your country. If you are not old enough to agree to these Terms yourself, a parent or legal guardian must do so where permitted by law.
You must provide accurate account information, keep your credentials secure, and promptly notify us of unauthorized use. You are responsible for activity under your account. You may not impersonate another person, create an account for someone without permission, or transfer your account.
2. The Service
ePortfolio lets creators build profiles and portfolios, discover and follow other creators, exchange messages, report safety concerns, and use related features. Features may change, be limited, or be discontinued. We do not promise that every feature will always be available or error-free.
3. Your content
You retain ownership of content you submit. You give ePortfolio a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt for technical purposes, display, distribute, and make your content available as needed to operate, improve, secure, and promote the Service. This license ends when your content is deleted from active systems, except where copies must remain for legal, safety, backup, or technical reasons.
You represent that you have all rights needed to submit your content and grant this license. You are responsible for your content and for respecting privacy, publicity, copyright, trademark, and other rights.
4. Acceptable use
You may not use the Service to:
- Post or send unlawful, fraudulent, deceptive, hateful, harassing, threatening, exploitative, sexually abusive, or dangerously violent content.
- Infringe intellectual property, privacy, publicity, or other rights, or publish another person’s sensitive information without authorization.
- Spam, manipulate engagement or discovery, operate fake accounts, or use automated means to scrape, access, or disrupt the Service without written permission.
- Upload malware, probe security, bypass access controls, interfere with the Service, or use it to harm another person or system.
- Circumvent moderation, suspensions, advertising consent controls, or technical limits.
- Use the Service for conduct that violates applicable law.
5. Moderation and enforcement
We may use automated tools and human review to assess content and conduct. We may reduce visibility, remove content, restrict features, suspend or terminate accounts, preserve evidence, or report matters to authorities when reasonably necessary. Where available, you may submit an appeal through the Service. We are not obligated to host any content and do not guarantee that all objectionable content will be detected.
6. Intellectual property and feedback
The Service, including its software, design, branding, and content provided by ePortfolio, is owned by or licensed to the operator and is protected by law. These Terms give you a limited, personal, revocable, non-exclusive, non-transferable right to use the Service as intended.
If you provide suggestions or feedback, you allow us to use them without restriction or compensation.
7. Third-party services and advertising
The Service may contain third-party links, tools, content, and advertising. Third parties may apply their own terms and privacy policies. We do not control and are not responsible for third-party services. Ads or promoted placements are not endorsements.
8. Termination
You may stop using the Service at any time. You may request account deletion by emailing wilfred.cruz.ph@gmail.com from your account email. We may suspend or terminate access when you violate these Terms, create risk or legal exposure, or when the Service is no longer offered. Provisions that by their nature should survive termination will remain in effect.
9. Inactive accounts
To manage storage, protect account security, and keep the Service available for active users, we may designate an account as inactive after 24 consecutive months without a successful sign-in or other authenticated, user-initiated use of the Service. Automated background activity, notification delivery, advertising activity, public views by other people, and unsuccessful sign-in attempts do not count as account activity.
Before deactivating an inactive account, we will send notices to the primary email address associated with the account and, where available, through in-app or push notifications. We normally send notices approximately 90 days, 30 days, and 7 days before the scheduled deactivation date. Each notice will explain the scheduled date, how to reactivate the account, and how to request access to or a copy of eligible account information.
You can cancel the scheduled deactivation by successfully signing in or otherwise using the Service while authenticated before the stated deadline.
On the scheduled date, we may deactivate the account and remove its profile and content from public access. We normally provide a further 30-day recovery period before permanently deleting account information and user content from active systems. After that recovery period, deletion may be irreversible.
Backup copies may remain in protected backup systems for up to 90 additional days and will not normally be used except for disaster recovery, security, or legal compliance. We may retain limited information for longer when reasonably necessary to comply with law, establish or defend legal claims, prevent fraud or abuse, preserve moderation or safety records, or protect the rights and safety of users. Any retained information remains subject to appropriate access and security controls.
Content copied or reshared by other users, information that has been irreversibly anonymized, and information retained by third parties may not be deleted with the account. Where required by applicable law, we may provide a longer notice or retention period.
You are responsible for keeping your account email address current. Sending notice to the contact information associated with your account constitutes notice, but we may use additional reasonable methods when an email cannot be delivered.
10. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that content is accurate, that users are who they claim to be, or that the Service will be uninterrupted, secure, or free of harmful components. Nothing in these Terms excludes rights that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, ePortfolio and its operator, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the claim or USD 100. These limits do not apply where prohibited by law.
12. Disputes and applicable law
Before filing a formal claim, you agree to contact us and try to resolve the dispute informally for 30 days. These Terms are governed by the laws that apply to the ePortfolio operator, without regard to conflict-of-law principles, except that mandatory consumer protections in your country continue to apply. Claims may be brought in a court with lawful jurisdiction. No provision requires individual arbitration or waives a right to participate in a class action unless you separately agree to it.
13. Changes and general terms
We may update these Terms to reflect changes to the Service or law. We will post revised Terms and update the effective date. If a change is material, we may provide additional notice. Your continued use after the revised Terms take effect means you accept them where permitted by law.
If any provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the Service. These Terms and the Privacy Policy are the entire agreement about your use of the Service.
